FlexWelder 服务条款

1. Definitions
- Service Provider — FlexWelder Hub Sp. z o.o., registered office at ul. Bojkowska 35A, 44-100 Gliwice, Poland.
- Service — the website https://flexwelder.com enabling account management.
- Application — FlexWelder Passport.
- User — Welder, Recruitment Agency, Employer or Certifying Body.
2. Scope and rules of service provision
The platform offers features tailored to the account type:
- welders maintain their welder passports and update professional data,
- recruitment agencies manage welders and communicate with employers,
- employers browse candidate profiles,
- certifying bodies have access to welders' certification history.
Selected accounts may require identity verification.
3. Conclusion and termination of the agreement
The agreement is concluded by registering in the Service and accepting these Terms.
Agreement term:
- paid services — fixed term (e.g. 12 months),
- free services — indefinite term.
The User may terminate the agreement in writing or by e-mail to office@flexwelder.com.
The Service Provider may terminate the agreement with a 30-day notice without giving a reason, or immediately in the event of a breach of these Terms.
Failure to pay results in access being blocked, and after 3 months from the block — permanent deletion of the account along with the data.
4. Fees and invoices
- use of the service may be paid in accordance with the Price List,
- the fee is paid "in advance" for the entire agreement; no refund is given on early termination,
- VAT invoices are issued electronically by default,
- the User consents to electronic invoices.
5. Copyright and ownership protection
All rights to the service, code, database and materials belong exclusively to the Service Provider or its licensors.
Copying, distributing, modifying or reverse-engineering the source code is prohibited.
The User obtains only a temporary right to use. Violations may result in immediate termination of the agreement at the User's fault and notification of law enforcement authorities.
6. Personal data and GDPR
Data processing is governed by the Privacy Policy available at /documents/privacy-policy.
Processed data:
- identification data (first name, last name, national ID),
- contact details (e-mail, phone),
- professional data (qualifications, certificates),
- technical data (IP, logs).
Data may be transferred to third countries (e.g. USA, India) using standard contractual clauses.
The Welder is the controller of their data within the scope of voluntary disclosure. Agencies and employers must process data in accordance with applicable data protection regulations.
7. User obligations
The User undertakes to use the service in accordance with applicable law, these Terms and good practice.
It is prohibited to:
- impersonate other persons,
- share an account with third parties,
- introduce unlawful or offensive content,
- mass-collect data without consent.
Welders must keep their profile data up to date.
Agencies and employers are obliged to process data lawfully, without supplying data that lacks the required consents.
8. Complaints
Complaints are submitted to office@flexwelder.com or in writing to the registered office address.
The complaint should contain contact details, a description of the problem, date of the event and the request.
The Service Provider will consider the complaint within 14 business days of its receipt.
In the absence of formalities, a request for completion may be sent within 7 days.
9. Amendments to the Terms
The Service Provider may amend the Terms in cases such as the need to align them with applicable law or functional changes.
Users will be notified electronically at least 7 days before the changes take effect.
The absence of objection within 7 days is deemed acceptance of the changes.
10. Final provisions
Matters not regulated are subject to Polish law (Act on Provision of Electronic Services, Civil Code, GDPR).
Disputes are resolved by the common court with jurisdiction over the Service Provider's registered office.
These Terms enter into force upon publication on flexwelder.com.
