Terms of Participation – AWS CWI Programme, Flexwelder Hub Sp. z o.o. Effective from 1 April 2026.
§1. General Provisions
1. These Terms and Conditions set out the rules for participation in the AWS Certified Welding Inspector (AWS CWI) programme organised by Flexwelder Hub Sp. z o.o.
2. The programme is organised by Flexwelder Hub Sp. z o.o., ul. Bojkowska 35A, 44-100 Gliwice, Poland, NIP: 9662195817, e-mail: aws@flexwelder.com, website: www.flexwelder.com.
3. The programme is delivered in cooperation with the American Welding Society (AWS), which is responsible for examination procedures and certification.
§2. Scope of the Programme
1. The programme may include, in particular:
- a. preparatory training,
- b. organisation of the Part B examination,
- c. support with the AWS application process,
- d. preparation for the Part C examination.
2. The scope of each edition of the programme is specified in the offer or communication sent to the Participant.
3. The Part C examination may be taken independently at external examination centres, including Prometric.
§3. Conditions of Participation
1. Participation in the programme is conditional upon meeting the formal requirements of AWS.
2. The Participant is required to submit all required documents within the deadline specified by the Organiser.
3. Failure to meet the formal requirements or to provide the complete set of documents may result in the Participant being refused admission to the examination.
4. The Participant is required to comply with the procedures of the Organiser, AWS, and any other external partners involved in the delivery of the programme.
§4. Registration and Conclusion of Contract
1. Registration for the programme is effected by submitting the data necessary for enrolment or for the issuance of a sales document to aws@flexwelder.com.
2. Submission of a registration constitutes acceptance of these Terms and Conditions.
3. The contract is concluded upon:
- a. confirmation of acceptance of the registration by the Organiser,
- b. issuance of a proforma invoice or invoice and acceptance of the registration for processing,
- c. receipt of payment, where the Organiser has indicated such a procedure.
4. The number of places is limited. Admission to the programme may be determined by the order of registrations or payments.
§5. Payments
1. Reservation of a place in the programme is conditional upon payment being made within the deadline specified by the Organiser.
2. Failure to make payment within the deadline may result in cancellation of the reservation.
3. The issuance of final documents or the transfer of data for subsequent stages of the process may be made conditional upon prior settlement of the full amount due.
§6. Withdrawal and Changes
1. Withdrawal from the programme requires the submission of an e-mail to aws@flexwelder.com.
2. Withdrawal after the conclusion of the contract entails the obligation to pay 100% of the programme fee.
3. The Participant's absence does not constitute grounds for a refund.
4. The Organiser may permit a change of Participant or the transfer of participation to another date, provided that organisational conditions and AWS requirements allow for it. Such consent requires express confirmation by the Organiser.
§7. Examination and Certification
1. AWS is responsible for the examination rules, the assessment of results, and the granting of the certificate.
2. Flexwelder is responsible for the organisation of the programme insofar as it falls within its control, in particular for training, logistical, and administrative matters.
3. Participation in the programme does not guarantee:
- a. admission to the examination,
- b. passing the examination,
- c. obtaining the AWS certificate.
4. The examination result depends on the Participant's preparation and compliance with the AWS requirements.
§8. Organisational Changes
1. The Organiser reserves the right to change the date, venue, schedule, or form of the programme for organisational, technical, or other reasons beyond the Organiser's control, including decisions made by AWS.
2. In the event that the programme is cancelled by the Organiser, the Participant shall be entitled to participate on an alternative date or to receive a refund of 100% of the fee paid.
3. The Organiser's liability is limited to the refund of the programme fee. The Organiser shall not be liable for indirect costs incurred by the Participant.
§9. Right of Withdrawal
1. A consumer and a privileged entrepreneur have the right to withdraw from a distance contract within 14 days of its conclusion, unless the performance of the service commenced with their express consent before the expiry of that period.
2. If the Participant requests the commencement of the service before the expiry of the withdrawal period, the provisions of generally applicable law concerning services commenced before the expiry of the withdrawal period shall apply.
3. A notice of withdrawal shall be sent to aws@flexwelder.com or to the registered office of the Organiser.
§10. Complaints
1. Complaints concerning the organisation of the programme shall be submitted to aws@flexwelder.com within 14 working days from the date of completion of the programme or the date on which the programme was scheduled to take place.
2. The Organiser shall consider the complaint within 14 days of its receipt, and in more complex cases no later than within 30 days.
3. A complaint may not concern the examination result or the certification decisions of AWS.
§11. Final Provisions
1. In matters not regulated by these Terms and Conditions, the Terms and Conditions for the provision of training, examination, and educational services of Flexwelder Hub Sp. z o.o. and the provisions of Polish law shall apply.
2. These Terms and Conditions shall enter into force on the date indicated in their header.
