Terms of Participation – AWS Certified Welding Inspector (AWS CWI) Programme, Flexwelder Hub Sp. z o.o.

Effective from 9 September 2026.

1. These Terms set out the rules for registration, participation, payment, withdrawal and organisation of the AWS Certified Welding Inspector (AWS CWI) programme, hereinafter the „Programme”.

2. The Programme is organised by Flexwelder Hub Sp. z o.o., ul. Bojkowska 35A, 44-100 Gliwice, Poland, NIP: 9662195817, e-mail: aws@flexwelder.com, website: www.flexwelder.com, hereinafter the „Organiser” or „Flexwelder”.

3. The Programme is delivered in connection with Flexwelder's cooperation with American Welding Society, Inc. („AWS”).

4. Flexwelder acts as an independent entity and is not entitled to make decisions on behalf of AWS regarding candidate qualification, examination results or the award of certificates. Under the agency agreement, Flexwelder and AWS remain independent entities and the agreement creates no partnership, joint venture or similar relationship.

5. AWS is responsible in particular for the proper verification of candidate qualifications, the examination rules, the assessment of examinations and the certification process. Under its agreement with Flexwelder, AWS reviews candidate applications against the qualification requirements.

1. Depending on the selected offer or edition, the Programme may include in particular:

• a. preparatory training for the AWS CWI examination,
• b. organisation or administration of the Part B examination,
• c. administrative support in the AWS CWI application and qualification process,
• d. preparation for the Part C examination,
• e. organisation of other elements of the AWS CWI certification process indicated in the offer.

2. The exact scope of services, the date, the venue, the price and the elements covered by a given edition of the Programme are set out in the offer, on the Flexwelder website or in the Flexwelder – Engineer Passport system.

3. Individual parts of the examination may be delivered in different places and formats, in line with the applicable AWS procedures.

4. Computer-based examinations may be delivered by an external examination operator, including Prometric or another operator designated by AWS.

5. Where a part of the examination is delivered at an external operator's examination centre, the Participant is also required to comply with that operator's terms, booking, rescheduling, cancellation and no-show rules.

1. Participation in the relevant stages of the Programme is conditional upon meeting the requirements set by AWS for the selected certification path.

2. The Participant is required to provide complete, true and current data and to submit all documents required for the qualification process.

3. The Participant submits the documents and data required in the registration process through the Flexwelder – Engineer Passport system, available via www.flexwelder.com.

4. The Participant is responsible for:

• a. the truthfulness of the information provided,
• b. the completeness of the documentation,
• c. the legibility of the submitted documents,
• d. the documents corresponding to the actual state of affairs,
• e. submitting them within the deadlines indicated by the Organiser.

5. Flexwelder may carry out a preliminary check of the completeness of the documents and ask the Participant to complete, correct or resubmit them.

6. A check carried out by Flexwelder is administrative in nature and does not confirm that the AWS qualification requirements have been met.

7. The final decision on whether a candidate meets the qualification requirements, on admission to the examination and on the application of a given certification path or of any waiver of part of the examination is taken by AWS.

8. A refusal by AWS to qualify the Participant, where it results from the Participant not meeting the AWS requirements, does not constitute non-performance or improper performance of the service by Flexwelder.

9. Where the refusal of qualification results from the Participant providing untrue data, incomplete documentation, failing to submit the required documents or submitting them too late for them to be processed properly, the Participant may be charged for the services already performed and for the costs incurred by the Organiser on the Participant's behalf which the Organiser cannot recover, subject to mandatory consumer law provisions.

1. Registration for the Programme takes place through the Flexwelder – Engineer Passport system, available via www.flexwelder.com.

2. As part of the registration, the Participant in particular:

• a. creates or activates an account,
• b. provides the required data,
• c. selects an available edition of the Programme, the training or the examination,
• d. submits the required documents,
• e. reads and accepts these Terms,
• f. makes the required declarations.

3. The Participant is required to use their own account and to provide data consistent with their identity document and with the documentation presented to AWS.

4. Submitting a registration does not mean automatic qualification for the examination by AWS.

5. Information about the status of the registration, the documentation, the payment and the further stages of the process may be made available in the Engineer Passport system and sent to the e-mail address assigned to the Participant's account.

1. Submitting a registration in the system means acceptance of these Terms.

2. The contract for participation in the Programme is concluded once the Organiser confirms that the registration has been accepted for processing and once the conditions indicated for the given edition are met, in particular the required payment.

3. Merely creating an account in the Engineer Passport or starting to complete the documentation does not constitute a seat reservation.

4. The number of places in each edition of the Programme is limited.

5. An effective seat reservation may depend in particular on:

• a. a correctly submitted registration,
• b. the required payment being made,
• c. the documents being submitted within the required deadline,
• d. the availability of a place in the given edition.

6. The Organiser may set additional deadlines for a specific edition regarding payment, documentation or qualification where this is necessary to meet the deadlines required by AWS.

1. The Participant is required to submit the required documents within the deadline indicated by the Organiser.

2. The deadlines indicated by Flexwelder may be earlier than the deadlines applicable between Flexwelder and AWS, because the Organiser must allow time to check the documents, to have them completed where necessary and to submit the application to AWS.

3. AWS requires the Agent to submit candidate applications electronically, as a rule no later than 28 days before the examination date. AWS may reject an application submitted after that deadline or charge an additional fee, and applications cannot be accepted later than two weeks before the examination.

4. Documents submitted by the Participant after the deadline indicated by Flexwelder may result in:

• a. the qualification process not being possible for the selected date,
• b. the Participant being moved to another available edition,
• c. additional costs being charged where these result from fees charged to Flexwelder or to the Participant,
• d. the Participant not being admitted to the examination on the selected date.

5. Flexwelder does not guarantee that documents submitted after the indicated deadline will be accepted or processed by AWS before the planned examination.

1. The price of the Programme and the payment terms are indicated in the offer for the given edition, in the Engineer Passport system or on the sales document.

2. A seat reservation may be conditional upon payment in full or in part within the deadline indicated by the Organiser.

3. Failure to pay within the deadline may result in:

• a. no seat reservation,
• b. cancellation of the reservation,
• c. the documentation not being sent to AWS,
• d. the Participant being unable to take part in the training or the examination.

4. Where, after the registration, Flexwelder incurs non-refundable external costs on behalf of or for the Participant, in particular fees payable to AWS or to the examination operator, those costs may be deducted from any amount subject to refund if the Participant later withdraws, to the extent permitted by applicable law.

5. AWS provides that certain services, once confirmed, may be irreversible, non-refundable and non-transferable to other services.

6. Examination results and the related documentation may not be released by AWS until the required payments to AWS have been settled.

1. Withdrawal from the Programme requires an unequivocal statement sent to aws@flexwelder.com.

2. Where the Participant withdraws, the Organiser settles the services already performed and the costs actually incurred for the Participant, in particular costs that the Organiser cannot recover from AWS, from the examination operator or from other entities involved in delivering the Programme.

3. Where the Participant's application has already been submitted to AWS, the examination has been confirmed, a code entitling the Participant to a computer-based examination has been issued, a named booking has been made or the Organiser has been charged a non-refundable external fee, the amount corresponding to those costs may not be refundable, to the extent consistent with applicable law.

4. For computer-based examinations, the Participant is responsible for booking the date correctly and for attending the examination. AWS indicates that failing to attend an examination or cancelling it improperly may result in the loss of fees and in additional costs.

5. For Participants who are consumers, or entrepreneurs granted consumer rights by law, this paragraph applies subject to mandatory legal provisions.

1. At the Participant's request, the Organiser may allow a change of the participation date or a change of the person of the Participant where:

• a. the organisational conditions allow it,
• b. the AWS procedures allow it,
• c. no services have yet been performed that would make such a change impossible.

2. A change of Participant may not be possible after a named application has been submitted to AWS or after other steps assigned to a specific candidate have been taken.

3. Rescheduling a computer-based examination may be subject to the rules and fees of the examination operator.

4. Any additional, justified costs arising from a change made at the Participant's request may be charged to the Participant where they have actually been incurred by the Organiser or result from the rules of an external entity.

1. The rules for conducting AWS examinations are set by AWS.

2. The Participant is required to follow the examination instructions, the examination security rules, the identification requirements and the instructions of persons authorised to supervise the examination.

3. Where an examination requires the use of a specific code or standard, the Participant is responsible for holding the correct edition of that document where, under the offer, providing it is the Participant's responsibility.

4. AWS requires the use, during the relevant examinations, of the correct edition of the official code or of a translation accepted by AWS; unauthorised copies or translations may not be permitted.

5. A breach of the examination rules may result in the consequences set by AWS, including the examination being stopped or invalidated.

6. Flexwelder does not decide the result of an examination.

1. AWS is responsible for:

• a. the proper assessment of whether the qualification requirements are met,
• b. the examination rules and procedures,
• c. the assessment of examinations,
• d. determining the examination result,
• e. the decision to grant or refuse a certificate.

2. Flexwelder provides the training and the administrative, organisational and logistical services within the scope set out in the offer.

3. Participation in the Programme, payment and completion of the training do not guarantee:

• a. qualification for the examination,
• b. admission to a specific part of the examination,
• c. the application of a waiver or other exemption,
• d. passing the examination,
• e. obtaining an AWS certificate.

4. Flexwelder has no right to change AWS qualification, examination or certification decisions.

1. The preparatory training is educational in nature and serves to prepare the Participant for the examination.

2. Completing the training does not guarantee any particular examination result.

3. The training and examination functions are separated in line with AWS requirements.

4. The person delivering the training does not decide the examination result or the certification.

AWS requires the agent to separate the training and examination functions; the person delivering the training may not take part in examining candidates, and a Test Supervisor may not take part in training them.

1. The Organiser may make a justified change to the date, venue, schedule or delivery method of the Programme where this is necessary for reasons of:

• a. organisation,
• b. technical circumstances,
• c. safety,
• d. an action or decision of AWS,
• e. an action of the examination operator,
• f. force majeure or other circumstances beyond the Organiser's control.

2. The Organiser will inform Participants of any material change without undue delay.

3. Where a change means that the service differs materially from the agreed scope or cannot be performed, the Participant will have the rights provided by applicable law.

4. Where the Organiser cancels a given edition for reasons attributable to Flexwelder, the Participant may be offered participation on another date or a refund of the amount paid for the part of the Programme not delivered.

5. Flexwelder is not liable for travel, accommodation, lost earnings or other indirect costs incurred by the Participant in connection with the Programme, to the extent that such exclusion of liability is permitted by applicable law.

1. The Participant acknowledges that part of the Programme depends on the actions and decisions of entities independent of Flexwelder, in particular AWS and examination operators.

2. Flexwelder is not liable for a delay in or failure to deliver a service resulting solely from an act or omission of a third party beyond Flexwelder's control, provided that Flexwelder has performed its obligations with due care.

3. Paragraph 2 does not limit the Participant's rights under mandatory legal provisions.

1. A Participant's failure to attend the training or the examination without having effectively changed the date or withdrawn beforehand in line with the applicable rules does not automatically give rise to a right to a refund.

2. In such a case, the Organiser settles the services already performed and the costs it cannot recover.

3. For external examinations, the AWS and examination operator rules on no-show, cancellation and rescheduling also apply.

1. A consumer, and an entrepreneur granted consumer rights in this respect by law, may withdraw from a distance contract within 14 days of its conclusion, without giving a reason, subject to the exceptions provided by law.

2. A withdrawal statement may be sent to aws@flexwelder.com or to the Organiser's registered address.

3. Where the Participant expressly requests that performance of the service begin before the withdrawal period expires and then withdraws from the contract before it has been fully performed, the Participant is obliged to pay for the services performed up to the moment of withdrawal, in proportion to the scope of the service delivered, in accordance with applicable law.

4. Where the service is fully performed before the withdrawal period expires at the Participant's express request, after the Participant has been informed of the loss of the right of withdrawal and has acknowledged that information, the right of withdrawal may expire in accordance with applicable law.

5. Where the Organiser is to begin delivering the Programme before 14 days have elapsed from the conclusion of the contract, the relevant consent and declaration of the Participant should be collected during the contracting process.

1. Complaints regarding the actions of Flexwelder or the organisation of the Programme may be submitted to aws@flexwelder.com.

2. A complaint should make it possible to identify the Participant and should describe the circumstances on which it is based.

3. The Organiser handles complaints within the deadlines resulting from applicable law.

4. Flexwelder is not entitled to change an examination result or an AWS certification decision.

5. Where a complaint concerns a matter within the competence of AWS or of the examination operator, Flexwelder will inform the Participant of that fact and, as far as it is able, indicate the appropriate way to proceed.

1. The primary system for handling the registration process and the documentation is Flexwelder – Engineer Passport.

2. The Organiser may send information to the e-mail address assigned to the Participant's account regarding:

• a. the status of the registration,
• b. missing documents,
• c. payments,
• d. training and examination dates,
• e. organisational changes,
• f. further steps required from the Participant.

3. The Participant is required to provide a current e-mail address and to check messages and information available in the system regularly.

4. The Participant should inform the Organiser of any change of contact details without delay.

1. Matters not governed by these Terms are subject to the relevant provisions of Polish law and, as regards certification and examination procedures, to the applicable AWS rules.

2. Where the Participant uses the Flexwelder – Engineer Passport system, separate terms of use of the system and rules on the processing of personal data may also apply, where these have been made available to the Participant.

3. These Terms neither exclude nor limit consumer rights arising from mandatory legal provisions.

4. Should any provision of these Terms prove invalid or ineffective, this does not affect the validity of the remaining provisions to the extent permitted by law.

5. These Terms enter into force on 9 September 2026 and apply to contracts concluded from that date.

The Polish version of these Terms is the legally binding version.
